1. Introduction

Welcome to African Pool Pros (“APP”). These Terms and Conditions (“Terms”) govern your use of the App, as powered by Africa Centre for Corporate Studies and is one of the products of the system and software development Training programs under The TECH-HUB MASTER Training Program. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

2. Use of the App

• Eligibility: You must be at least 18 years old to use the App. By using the App, you represent that you meet this age requirement.
• Account Registration: You may be required to create an account to access certain features of the App. You agree to provide accurate and complete information during registration and to keep your account information updated.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify the Company immediately of any unauthorized use of your account.

3. Play Modes

The African Pool Pros App offers two play modes: Online Mode and Offline Mode, each designed to provide different gaming experiences.

• Online Mode: In Online Mode, players can compete against real opponents globally, engage in multiplayer matches, and climb leaderboards while staking real currency and enjoying real-time gameplay. This mode requires an active internet connection and enables features like friend invitations, chat, and live rankings.
• Offline Mode: In Offline Mode, on the other hand, allows players to practice their skills without internet connectivity. This mode is designed for training and entertainment, offering up to 50 practice games per session to hone gameplay tactics, improve accuracy, and familiarize oneself with the game mechanics. While offline, users won’t be able to compete for real stakes or connect with other players, but they can refine their strategies in preparation for online competitions.

4. Payments and Transactions

• Payment Integration: Payments within the App are facilitated through various globally accepted forms of payment, including but not limited to mobile wallet, credit/debit cards, and other digital payment methods. By using these payment methods, you agree to their respective terms and conditions.
• Instant Deposits and Withdrawals: The App guarantees instant deposits and withdrawals as supported by the various payment methods. Should there be an issue, the Company will strive to resolve it within 72 hours to the best of their ability.
• Transactions: All transactions made within the App are final and non-refundable. The Company is not responsible for any disputes arising from transactions made through the App.

5. User Conduct

You agree not to engage in any of the following prohibited activities:

• Violating any applicable laws or regulations.
• Infringing the intellectual property rights of others.
• Using the App for any fraudulent or deceptive activities.
• Interfering with or disrupting the operation of the App.

6. Intellectual Property

The App and all its content, including but not limited to text, graphics, images, software, and trademarks, are the property of the Company and its licensors. You agree not to copy, reproduce, distribute, or create derivative works from any content on the App without the Company’s prior written consent.

7. Privacy

The Company collects and uses your personal information in accordance with its Privacy Policy. By using the App, you consent to such data collection and use.

8. Disclaimers and Limitation of Liability

• Disclaimers: The App is provided “as is” and “as available” without warranties of any kind, either express or implied. The Company does not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components. The App is purely for learning and entertainment purposes and should not be perceived as an income-generating venture. This game can be addictive. Players are therefore encouraged to play responsibly.
• Limitation of Liability: To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your use of the App or violation of these Terms.

10. Modifications to the Terms

The Company reserves the right to modify these Terms at any time. If we make material changes to the Terms, we will provide notice through the App or by other means. Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the modifications.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

13. Skill-Based Competition

African Pool Pros is a platform for skill-based competitions only. All game outcomes are determined by the skill, knowledge, and performance of the participants. No element of chance determines the winner. Coins earned or awarded within the app represent competition results and may be redeemed in accordance with our payout policy.
